Booking Terms

Copyright & booking terms.

These terms apply to every session booked with Kate & Alex MacAulay Photography. When you book, you agree to them. We've kept them as plain as we can - if anything is unclear, just text or call us at (902) 488-4949.

Rescheduling

You may reschedule your session up to 2 times. Reschedules must be made at least 24 hours before your session date and time.

1. Ownership

Kate & Alex MacAulay Photography is the author and owner of copyright in all photographs created during your session, under the Copyright Act (Canada). Booking a session or purchasing products does not transfer copyright.

2. Proofs are for selection only

Proof images shared in your online gallery or at the studio are provided only so you can choose the images you wish to purchase. Proofs may not be downloaded, screenshotted, printed, copied, shared, edited, enhanced, upscaled, or reproduced in any form.

3. Agreement regarding personal use

Section 32.2(1)(f) of the Copyright Act allows a person who commissions a photograph for personal purposes to use it for private or non-commercial purposes unless the parties agree otherwise. By booking, you agree otherwise as follows: personal-use rights apply only to images you have purchased as prints or digital files, and only in the form delivered by the studio. They do not apply to proofs.

4. Watermarks and copyright notices

Watermarks, copyright notices, and studio identification on proof images are rights management information under section 41.22 of the Copyright Act. You agree not to remove, alter, or obscure them by any means, including AI editing or watermark-removal tools, and not to ask or allow anyone else to do so.

5. Purchased digital files

Purchased digital files come with a personal print release allowing you to print them for personal use and share them on personal social media. A credit to Kate & Alex MacAulay Photography is appreciated. Purchased images may not be used commercially, sold, entered in contests, or altered in a way that misrepresents the studio's work without written permission.

6. Unauthorized use

If proofs are reproduced or a watermark is removed in breach of these terms, the studio may invoice for the use at its current price for the equivalent print or digital product, without limiting any other remedy available under the Copyright Act.

7. Minors

Where the subject is under 18, a parent or guardian accepts these terms on their behalf.

8. Governing law

These terms are governed by the laws of Nova Scotia and the federal laws of Canada that apply there.
